1. Company Information

JetskiDubrovnik.Com is operated by Monza Gruppo d.o.o., a company registered in Croatia with OIB: 54419028561, whose registered address is Od gaja 56, 20000 Dubrovnik, Croatia.

2. Definitions

In these Terms and Conditions, the following terms shall have the following meanings:

  • "Company" refers to Monza Gruppo d.o.o., operating under the name JetskiDubrovnik.Com.
  • "Customer" refers to any individual or entity that books and/or uses the services offered by the Company.
  • "Service" refers to the jet ski rental and related activities provided by the Company.
  • "Booking" refers to a reservation made by a Customer for a Service on a specific date and time.
  • "Equipment" refers to jet skis, life jackets, and any other items provided by the Company for use during the Service.
  • "Damage" refers to any harm, impairment, or deterioration to the Equipment beyond normal wear and tear.
  • "Website" refers to JetskiDubrovnik.Com and all its subdomains.

3. Booking and Payment

  • Bookings can be made through our website, by phone, or in person at our location.
  • All bookings require either a deposit (30% of the total amount) or full payment in advance.
  • Customers who pay a deposit must pay the remaining balance before the start of the service.
  • Full payment in advance qualifies for a 5% discount on the total price.
  • Payment can be made using credit/debit cards or other electronic payment methods available on our website.
  • Prices are indicated in Euro (€) and include VAT (PDV).
  • The Company reserves the right to change prices at any time, but changes will not affect existing confirmed bookings.
  • ALL PAYMENTS ARE FINAL AND NON-NEGOTIABLE once the service has been provided or in case of no-show.

4. Cancellation Policy

  • Deposits are non-refundable under any circumstances.
  • Bookings can be rescheduled free of charge up to 24 hours before the scheduled time.
  • Rescheduling requests with less than 24 hours' notice are subject to availability and may incur additional fees.
  • No shows will be charged the full amount with no refund.
  • In case of severe weather conditions that the Company deems unsafe for jet ski operation, the booking will be rescheduled to a later date at no additional cost, or the customer may receive a full refund (excluding the deposit).
  • The Company reserves the right to cancel any booking due to unforeseen circumstances. In such cases, a full refund will be issued.
  • Weather determination is at the sole discretion of the Company and is final.

5. Age and Eligibility Requirements

  • The minimum age to operate a jet ski is 18 years.
  • Customers must present a valid photo ID when checking in for their booking.
  • Children under 18 may ride as passengers only when accompanied by a parent or legal guardian.
  • The Company reserves the right to refuse service to anyone who appears to be under the influence of alcohol or drugs.
  • Pregnant women and persons with certain medical conditions (heart problems, back issues, etc.) are advised not to participate in jet ski activities.
  • BY PARTICIPATING, CUSTOMERS CONFIRM THEY ARE IN GOOD PHYSICAL HEALTH and have no medical conditions that would prevent safe participation.

6. Safety and Operating Rules

  • All Customers must follow safety instructions provided by the Company's staff.
  • Life jackets must be worn at all times while operating or riding on a jet ski.
  • Customers must remain within designated operating areas and adhere to speed limits.
  • Reckless operation, racing, or stunts are strictly prohibited.
  • Maximum weight and passenger limitations per jet ski must be observed.
  • In case of any mechanical issue or emergency, Customers must immediately notify the Company's staff.
  • Failure to comply with safety rules may result in immediate termination of the Service without refund and liability for any resulting damage.
  • VIOLATION OF SAFETY RULES VOIDS ALL INSURANCE COVERAGE and makes the Customer fully liable for all damages and injuries.

7. Damage Policy and Liability

BY MAKING A BOOKING AND USING OUR SERVICES, THE CUSTOMER ACKNOWLEDGES FULL RESPONSIBILITY FOR ANY DAMAGE CAUSED TO THE EQUIPMENT.
  • ALL DAMAGE, WITHOUT EXCEPTION, WILL BE CHARGED TO THE CUSTOMER. This includes, but is not limited to, scratches, dents, water damage, mechanical damage, and any other impairment to the jet ski or other equipment.
  • Before using the Equipment, the Customer will be required to inspect it together with our staff and acknowledge its condition by signing a condition report.
  • A mandatory security deposit of €500 per jet ski is required before service commencement. This deposit will be secured via credit card pre-authorization or cash.
  • Upon return, the Equipment will be inspected by our staff. Any damage identified will be documented and charged to the Customer immediately.
  • If damage is discovered after the Customer has left (hidden damage), the Company reserves the right to charge the Customer's credit card or pursue payment through all legal means available.
  • For damage exceeding the security deposit amount, the Customer remains fully liable for the complete repair costs and agrees to pay the full amount.
  • The Company maintains detailed records including pre and post-rental photos, video recordings, and signed documents which will be used as evidence in case of disputes.
  • Customers cannot avoid damage payment by leaving the premises, providing false information, or any other means. The Company will use all legal remedies to recover damage costs, including but not limited to filing police reports, pursuing legal action, and engaging collection agencies.
  • By accepting these Terms, the Customer authorizes the Company to charge any damage costs to the credit card used for booking/deposit.
  • DAMAGE ASSESSMENT BY THE COMPANY IS FINAL AND BINDING.
  • REFUSAL TO PAY FOR DAMAGES will result in immediate filing of criminal charges for property damage and civil proceedings for full recovery of costs plus legal fees.

8. Insurance and Waivers

  • Jet ski activities involve inherent risks. Customers participate at their own risk.
  • The Company carries commercial liability insurance for certain accidents, but this insurance DOES NOT cover damage caused by Customer negligence, reckless behavior, or violation of safety rules.
  • Prior to service commencement, all Customers must sign a liability waiver acknowledging the risks involved in jet ski activities.
  • The signed waiver does NOT exempt Customers from financial responsibility for damage to Equipment.
  • The Company is not responsible for personal belongings or items left unattended.
  • Customers are advised to check their personal travel insurance coverage for adventure activities.
  • THE LIABILITY WAIVER IS LEGALLY BINDING and enforceable under Croatian law.

9. Documentation Requirements

  • All Customers must provide a valid photo ID (passport or national ID card).
  • For security purposes, the Company may take a copy of the Customer's ID and credit card.
  • The Customer agrees to sign the following mandatory documents:
    • Equipment condition report (before and after use)
    • Liability waiver
    • Security deposit authorization form
    • Acknowledgment of these Terms and Conditions
  • Refusal to provide required documentation or sign required forms will result in cancellation of the booking without refund.
  • PROVIDING FALSE INFORMATION is a criminal offense and will be prosecuted to the fullest extent of the law.

10. Legal Enforcement and Collection

  • UNPAID DAMAGES OR FEES will accrue interest at the legal rate of 8% per annum from the date due.
  • The Company will engage professional debt collection agencies for any unpaid amounts.
  • All collection costs, including agency fees, legal fees, and court costs, will be added to the Customer's debt.
  • The Company will report unpaid debts to credit reporting agencies in the Customer's country of residence.
  • For foreign customers, the Company will pursue collection through international legal channels and treaties.
  • ATTEMPTING TO LEAVE CROATIA with unpaid damages may result in border detention and criminal charges.

11. Video and Photo Evidence

  • The Company records all equipment handovers and returns on video.
  • Photos are taken before and after each rental to document equipment condition.
  • Customers consent to being recorded for security and evidence purposes.
  • All recordings may be used as evidence in legal proceedings.
  • RECORDINGS ARE STORED FOR A MINIMUM OF 2 YEARS and may be shared with law enforcement and legal representatives.

12. Privacy Policy

The Company collects and processes personal data in accordance with applicable Croatian and EU laws, including the General Data Protection Regulation (GDPR). Customer information will only be used for booking processing, service provision, damage assessment documentation, and legally required records. For more details, please refer to our Privacy Policy.

13. Modifications to Terms and Conditions

The Company reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the website. It is the Customer's responsibility to review these Terms and Conditions periodically. CONTINUED USE OF SERVICES CONSTITUTES ACCEPTANCE of any modifications.

14. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of Croatia. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Dubrovnik, Croatia. The Company reserves the right to pursue legal action in the Customer's country of residence if necessary for damage recovery.BY ACCEPTING THESE TERMS, CUSTOMERS WAIVE ANY JURISDICTIONAL OBJECTIONS and agree to Croatian law and courts.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Company and the Customer and supersede all prior agreements, understandings, and representations.NO VERBAL AGREEMENTS OR PROMISES by staff members can modify these Terms and Conditions.
